1. Acceptance of Terms
By registering for a MarketScout account or continuing to use the platform, you agree to be bound by these Terms of Service and all accompanying policies. If you do not agree to these terms, do not use MarketScout. Your continued use of the platform after any updates to these terms constitutes acceptance of those changes.
2. Platform Description
MarketScout is an affiliate product discovery engine operated by MarketScout Enterprise, a Philippine company. The platform helps Amazon Associates creators browse curated Amazon products, generate tracked affiliate codes, and earn commissions on sales referred through their unique links. MarketScout is not owned by or affiliated with Amazon.com or Amazon.sa.
3. Eligibility
To use MarketScout, you must:
- Be at least 18 years old at the time of registration.
- Provide a valid email address and create a password.
- Have (or intend to apply for) a valid Amazon Associates account in at least one supported marketplace (US or Saudi Arabia).
- Not be prohibited from using affiliate marketing services under applicable law.
MarketScout reserves the right to suspend accounts that do not meet these requirements.
4. Creator Roles
MarketScout supports three creator roles within its binary genealogy and affiliate system:
- Creator Leader: A top-tier creator (Partner or Ambassador tier) who originates a team branch in the binary genealogy. They receive binary matching bonuses and upline earnings from their downline.
- Team Origin Creator: A creator placed at the origin of a new team in the binary tree. They accumulate Side A and Side B volume and are eligible for binary match bonuses when both sides are active.
- Individual Creator: A standard creator (Free or Pro tier) who shares affiliate links, earns direct commissions, and may refer other creators. Individual creators can upgrade tiers based on sales and downline activity.
5. Registration and Account
When you register, you agree to:
- Provide accurate, complete information and keep it up to date.
- Maintain the security of your account password — you are solely responsible for all activity under your account.
- Notify us immediately at support@marketscout.com if you suspect unauthorized access.
- Accept referrals and assign new creators to the side with fewer members (auto-balance placement), which you acknowledge upon registration.
6. Referral and Commission Rules
MarketScout's affiliate commission system operates across four layers:
- Layer 1 — Direct Commissions (85% to Creator): When a user clicks your affiliate link and makes a purchase on Amazon, you earn 85% of the applicable commission. MarketScout retains 15% as a platform fee. Commission rates vary by product category (2%–5%).
- Layer 2 — Downline Referrer Earnings (10%): When a creator you referred earns a direct commission, you receive an additional 10% of that commission as a downline referral bonus.
- Layer 3 — Binary Matching (15% of Lesser Volume): When both your Side A and Side B are active with qualified downline creators, and both sides generate commission volume, you receive a 15% binary match bonus on the lesser volume side.
- Layer 4 — Founder Reserve Pool (Sliding Scale): A monthly platform pool funded by 5%–20% of gross platform commission, distributed to qualifying creators based on activity weight and tier.
Commission calculations are final when confirmed by Amazon. MarketScout acts as an intermediary — commission disputes are governed by Amazon Associates policy. Tier upgrades are processed monthly based on the criteria published on the dashboard.
7. Affiliate Program Compliance
As a MarketScout creator, you must comply with Amazon Associates Program policies:
- You must maintain a valid Amazon Associates account in good standing.
- All affiliate links must include your unique affiliate tag or code.
- You must disclose your affiliate relationship in any content where you share affiliate links (e.g., "This is an affiliate link — I earn a commission at no extra cost to you").
- Prohibited content: spamming, misleading product claims, counterfeit product promotion, or promoting products via unauthorized channels (SMS, unsolicited email, fake review sites).
- Amazon may claw back commissions for returned items, cancelled orders, or policy violations. MarketScout will deduct clawed-back amounts from your balance accordingly.
8. Prohibited Conduct
You agree NOT to:
- Use automated tools, bots, or scripts to generate clicks or fake conversion data.
- Post affiliate links in spaces where affiliate marketing is prohibited (certain forums, Reddit, Facebook groups with specific rules, etc.).
- Make false, misleading, or fraudulent claims about any product on the platform.
- Use MarketScout's name, logo, or branding without written permission.
- Violate any applicable law or regulation in connection with your use of the platform.
- Attempt to manipulate the binary placement, genealogy tree, or commission calculations.
Violation of any of these terms may result in account suspension, forfeiture of pending commissions, and referral to law enforcement if applicable.
9. Stripe Connect Payout Terms
Payouts are processed via Stripe Connect Express:
- Minimum Payout: USD 50.00 (or equivalent in your currency). Requests below this threshold will not be processed.
- Processing Time: Stripe transfers typically complete within 5 business days after a payout request is approved.
- Processing Fee: MarketScout does not charge a payout fee. However, Stripe may charge its own fees, which are disclosed at the time of the request.
- Stripe's Terms: Your use of Stripe Connect is subject to Stripe's Connected Account Agreement.
- Failed Payouts: If a payout fails due to incorrect bank details, you must update your Stripe account information and request a new payout. MarketScout is not responsible for incorrect payout details.
10. Intellectual Property
MarketScout's name, logo, design, text, and all platform content are the exclusive property of MarketScout Enterprise. You receive a limited, revocable license to use the MarketScout branding for the sole purpose of promoting your affiliate links in accordance with these terms. You may not use MarketScout branding in a way that implies endorsement by MarketScout of your content.
11. Disclaimers and Limitation of Liability
MarketScout is provided "as is" and "as available" without warranties of any kind. We do not guarantee:
- That the platform will be error-free, secure, or uninterrupted at all times.
- That affiliate commission rates will remain unchanged — Amazon updates commission rates periodically.
- That your earnings will meet any particular target or that you will earn any money at all.
To the maximum extent permitted by law, MarketScout Enterprise and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of your use of or inability to use the platform.
